Abstract

This thesis examines the status and protection of Hezbollah militia during the 2006 Lebanon armed conflict. The purpose of this thesis is to investigate the ambiguity upon the status of Hezbollah militia that effects their legal protection by examining it in conjunction with the International Humanitarian Law. This thesis uses normative law research method, a method based on the usage of legislations, jurisprudences, treaty, International customary law and the general principles of law that lives within the society. This thesis concludes that based upon article 43 of First protocol, 1977 the member of Hezbollah militia deserved the status of combatant during the 2006 Lebanon armed conflict and must be treated as a prisoner of war. In the end this thesis recommends that independent investigation and a fair trial be held a for the members Hezbollah militia that were captured. If they are proven guilty of violating the International Humanitarian law, then they are punishable under the Israel national law, but if they aren't proven guilty, they shall be returned to their home country and be compensated of the treatment received during their custody. This thesis also recommends the conception of additional part of Humanitarian Law that deals with clearer partitioning of lawful combatant, and the better socialization of the International Humanitarian Law to keep the same problem of reoccurring
