Abstract
Fine criminal sanction is one of the sanctions of which is often used for managing the criminal action of traffic violation. Fine criminal sanction is regulated in the Act Number 14 of 1992 on Traffic and Highway Transportation, and is purposed to depress the level of traffic violation of which often occur in Indonesia. However it will be a new problem if by the existence of this fine criminal sanction, traffic violation instead increases and often behaves as the primary reason of traffic accident. In this legal writing, the author conducted a research to know whether the fine criminal sanction of which is regulated in the Act Number 14 of 1992 can depress the level of traffic violation in Sleman Regency. This research was directly conducted in field and focused on legal societal behaviours (law in action). Based on the result of author’s findings, it founded any fact that traffic violation that occurred in Sleman Regency increase over time in the period of last three years. It proved that the fine criminal sanction of which is regulated in the Act Number 14 of 1992 is not effective in depressing the level of traffic violation in Sleman Regency. Thus, it has been appropriate that this regulation is substituted with the new one. Currently, the government is preparing new draft of law on Traffic and Highway Transportation for substituting the Act Number 14 of 1992. Hopefully, this draft of law will be more effective in depressing the level of traffic violation in Indonesia.
