Abstract

The title of the writing of this law is the implementation of the Witness Protection Law and Victims of Domestic Violence By Police In the Investigation Process. There are the purposes of writing : 1) For implementation of legal protection for witnesses and victims of domestic violence bye the police in the investigation process, 2) To understand the factors that hamper the implementation of legal protection by the police to witnesses and victims of domestic violence during the investigation process. This type of research is a normative legal research, the research that examine the laws and regulations relating to the protection of witnesses and victims and about the violence in the household. The main source of data that are needed in this research is secondary data. Based on the results of research, discussion and analysis of data can be concluded that the implementation of law for the protection of witnesses and victims of domestic violence by the police in the investigation conducted by referring to provisions in article 5 of Law No. 13 of 2006 on Protection for Victims and Witnesses, Statute In 2006 the Republic of Indonesia No. 24, and Law No. 23 of 2004 on the Elimination of Domestic Violence. When the victims need protection in a safe place, then referred to the safe house. The factors that hamper the implementation of legal protection by the police to witnesses and victims of violence in the home process of investigation are : 1) if the victim must be worked out from the safe house, so this will complicate the process of investigation, 2) forms protection that must be given to victims and witnesses have not been regulated by law, 3) there has been no ruling from the court procedures.
