Abstract

Smartphone trading through the online section makes it easier for people to make buying and selling transactions. This convenience makes this trade misused in blackmarket smartphone sales. This legal research uses normative research with a status approach. Legal settlement is carried out preventively through the Regulation of the Director General of Customs and Excise Number PER-05/BC/2020, blackmarket smartphones cannot be used because they do not have an IMEI. Regulation of the Minister of Finance of the Republic of Indonesia Number 199 /Pmk.Ol0/2019 concerning Customs, Excise, and Tax Provisions on the Import of Consigned Goods stipulates that documents for shipping goods must be complete to be sent by the sender to the recipient based on the provisions of the applicable documents in all shipments including smartphones or other electronics. Meanwhile, repressive legal settlements through the applicable criminal law that lead to imprisonment or prosecution for damages, there are criminal threats and fines for trafficking in contraband goods are regulated in Law No. 17 of 2006 concerning Customs. While administrative sanctions are obtained if they violate the Regulation of the Minister of Trade No. 26 of 2021 concerning Stipulation of Standards for Business Activities and Products in the Implementation of Risk-Based Business Licensing in the Trading Sector, it is regulated that producers and importers are obliged to complete each electronic and telematics product with instructions for use and a guarantee card in Indonesian before being traded on the market. in the country that has been affixed with the registration number, the sanctions can be in the form of paying a certain amount of money and the product is withdrawn and the shop is permanently closed for the seller.
