Abstract

This thesis is entitled "The Relevance of Emergency Law Number 12 of 1951 to Mandau Culture of the Benuaq Dayak Tribe in West Kutai Regency." The problem that occurs in this case is where the saber/machete or "ekeq" (in Benuaq Dayak language) is a traditional weapon of the Benuaq Dayak tribe. In the tradition of the Benuaq Dayak community in West Kutai, there are no specific rules that provide sanctions regarding the use of sharp weapons among the community, so that people are free to carry Mandau anywhere, including carrying it for the reason of protecting themselves from danger that threatens the safety of their lives. always carrying a saber wherever he steps. The custom of this community has been passed down from generation to generation and still persists to this day. For the Benuaq Dayak people in West Kutai, the saber is an important part of people's identity, including its function to protect themselves. But actually this kind of action is a violation of provisions of Emergency Law Number 12 of 1951 with a penalty of 10 years in prison. However, in its implementation, the Police in West Kutai were given fines and confiscation sanctions. The main problem that this research wants to answer is whether the Emergency Law Number 12 of 1951 is still relevant for use by the Police in law enforcement related to sharp weapons crime which is associated with the existence of the Benuaq Dayak tribe's mandau culture? The research method used by the author is a normative research method. As for the results of the research that the Emergency Law Number 12 of 1951 is no longer relevant in terms of the aspect of justice in the current development of society for use by the Police in law enforcement against criminal acts of sharp weapons. So it needs to be changed so that it is better and complete.
