Abstract

As a result of rapid technological development, internet has become one of the important product that can be used as a tool to support a modern life era. Among the various functions of internet, the dominant one is used as a tool to create a new system of trade that known as E-commerce. Electronic trade has no borders, time or space in execution. It only needs computer and internet. But there are still many juridical problems found in the execution of e-commerce, one of the problems is about the unclear legal relationships that occur between the parties and the lack of guarantees of rights. Consumer rights in e-commerce due to 5 main points, namely the lack of security in transactions and making payments and the guarantee of certainty that the information the consumer needs, the unprotect protect rights? rights of consumers to complain / compensation, security of goods / services purchased, the last problem is the last is a matter of jurisdiction and competence of the forum. Is all because the reach of Law No.8 of 1999 on Consumer Protection applies only limited areas of the Republic of Indonesia and not specifically talk about ecommerce. In the year of 2000, Indonesia has issued a draft of the Use of Information Technology, but the enactment has not been done until this time. According the author, The Specific regulations regulating e-commerce is very a crucial value. In fact, these settings have higher coverage is broad because it covers territory well beyond the scope of the Republic of Indonesia. So the problem that one side has a higher status than other parties can be balanced and the potential of e-commerce market that big can be together? as achieved by consumers and businessmen and other parties concerned.
