Abstract

Crime is a thing that often happens in society. The existence of a crime requires criminal responsibility. Indonesia as a law state still has a justice system whose accountability tends to lead to the imposition of sanctions on perpetrators of crimes which is called retributive justice. Along with developments in society, a case settlement method is needed by bringing together victims and perpetrators so that mediation is carried out in finding solutions and ending in the termination of prosecution of the perpetrators. In criminal law the settlement of these cases is known as restorative justice where the goal to be achieved is the restoration of the victim to its original state and justice for the perpetrator.Settlement of cases with a restorative justice approach focuses on the level of the prosecutor's office as a part of the justice system that has authority in prosecution. Regulation also allows the prosecutor's office to terminate prosecutions based on restorative justice by issuing Prosecutor's Regulation number 15 of 2020 concerning termination of prosecutions based on restorative justice. The case study used in this paper is a case study with case number Print -2553/M.2.10/Eoh.2/07/2022. The author examines how restorative justice is implemented, the suitability of the terms and procedures for stopping prosecution by the prosecutor so that the act of stopping prosecution can answer community problems, especially for justice seekers.
