Abstract

As a rule of law and democracy, the State of Indonesia is obliged to protect the rights of Persons with Disabilities as the international world has also recognized the existence and position of persons with disabilities. The title of this writing is Participation of Persons with Disabilities in the Formation of Yogyakarta City Regional Regulation Number 4 of 2019 concerning the Promotion, Protection, and Fulfillment of the Rights of Persons with Disabilities. This writing aims to see how Indonesia implements the rule of law and democracy in the formation of laws and regulations that involve the public in the process, especially in the formation of PERDA Yogyakarta City Number 4 of 2019. Persons with Disabilities who have the same position as other citizens of course participate involved in the process of forming PERDA Yogyakarta City Number 4 of 2019 where persons with disabilities can convey their aspirations, input, and suggestions so that the formation of PERDA by the circumstances and needs of persons with disabilities. This legal research uses primary legal materials and secondary legal materials. This primary legal material was obtained from the results of interviews with several relevant sources, while secondary legal material was obtained from laws and regulations, the internet, journals, news, research reports, and books. After the primary data is analyzed qualitatively, the secondary data is described using sentences that explain the data. Drawing conclusions is carried out using the deductive method, namely concluding from what already exists or the truth is known and ending with new, special knowledge conclusions. The results of this legal research are that establishing PERDA Kota Yogyakarta No. 4 of 2019 actively involves persons with disabilities from the beginning to the end of the process. However, several disability organizations were not involved in the establishment of the Yogyakarta City Regional Regulation Number 4 of 2019 because the government prioritizes a representation system and each forum has its quota and has limited ability to accept all aspirations.
