Abstract

This undergraduate thesis entitled "The Takeover of Use Rights to the Building in Obtaining Legal Protection due to the Implementation of Government Regulation (PP) Number 24 year 1997 on the Land Registration at Kec. Sewon, Bantul District of DIY Province” aims to figure out whether or not the Use Rights to build's Certificate acquired from the takeover process give legal protection to its owner concerning the regulation stated on Goverment Regulation Article 32 Clause 2 on the possibility of the another party to think of same right to sue within 5 years period of time since the certificate is issued. The purpose of this research is to find out, study, and analyse the takeover of use rights to build in order to achieve legal protection due to the implementation of Goverment Regulation Number 24 year 1997 on land registration at Sewon Sub district of Bantul District. In order to understand the real situation of the use rights to building in obtaining the legal protection at Sewon Sub districtof Bantul District, the writer applied empirical law research methodology that focuses on the behaviour or phenomenon of citizens and is based on primary date gathered from that citizens as well as secondary data. The result of this research shows that 38,75% of the certificate owners (of use rights to building) at kec Sewon of Bantul District had conducted Land Registration and obtained the certificates issued by the local Land Registry/Office of Bantul. Most respondents that have been the owners of certificates (of use right to building) have never been sued by any other party in terms of the rights to that land they have been used. Therefore, it can be concluded that the take over of use rights to building achieve a state of legal protection since Goverment Regulation Number 24 Year was implemented.
