Abstract

The title of legal writing in this study is the control of environmental damage due to illegal sand mining in Pakkat distric, Humbang Hasundutan Regency, Where the problem in this research is environmental damage due to illegal sand mining business activities. The purpose of this research is to find out how to control environmental damage due to illegal sand mining business activities and what are the obstacles in controlling environmental damage due to illegal sand mining activities. Control includes prevention, countermeasures and recovery. The writing of this law uses the empirical writing method wherein this writing takes into account social facts in the field and the data is obtained from several interviews with respondents, books, and sources of information. The conclusion of this study is that the Humbang Hasundutan Regency Environmental Service has not carried out optimal executions where control in the form of prevention already exists in the form of monitoring, socializing and advising mining business actors that every mining business activity must have a mining business permit and give an announcement by letter explaining the environmental damage as a result of the illegal sand mining activities/activities. Meanwhile, control in the form of prevention and recovery has not yet been carried out because the Office cannot exercise control over business activities that do not have a mining business permit, Even so, the Environmental Agency of East Lampung Regency has done its best. The author has suggestions to the Environmental Service and to the central government, namely the District Environmental Service as a representative of the central government should be given the authority to issue mining business permits in order to minimize illegal business activities and also need to increase the active role of the Humbang Hasundutan District Environmental Service in carrying out outreach and education to the community.
