Abstract

This research is based on problems related to the judge's consideration in examining cases of child sexual abuse associated with Restorative justice in decision No. 50/pid.sus/2013/pn.ska. in accordance with the principle of restorative justice in concept, namely the restoration of children as victims and perpetrators of criminal acts. The purpose of this study is to find out and analyze whether the judge's considerations in decision No. 50/Pid.Sus/2013/PN. Ska. is in accordance with the principles of Restorative justice and analyzes how to fulfill the rights of children as perpetrators and victims of criminal acts in Decision Number 50 / Pid.Sus / 2013 / PN. Ska. This research uses normative legal research methods with a case approach and a statutory approach. The result of this study is that the judge's consideration in the judgment Number: 50/Pid.Sus/2013/PN. Ska. has not been in accordance with the principles of the Juvenile Criminal Justice System Act which aims to realize Restorative justice in the sense of concept. Sanctioning children who commit criminal acts should be the right choice, because both victims and perpetrators should get better recovery for the growth of the child, in accordance with the Juvenile Criminal Justice System Act and the Disability Act.
