Abstract

ORI DIY Representative is an ombudsman office located in Special Region of Yogyakarta Province. The ORI DIY representative functions as an external supervisory agency overseeing the performance of the Yogyakarta Food and Drug Supervisory Agency (BBPOM) in carrying out public administration, including cases of drug syrup contaminated with ethylene glycol and diethylene glycol exceeding the safe threshold. This study aims to find out how the practice of the supervisory role is carried out by the ORI DIY Representative against BBPOM Yogyakarta, the obstacles and solutions that have been made to solve them. This research uses a type of normative research with the main source in the form of library research and supplemented by supporting sources obtained from interviews. The research results obtained are that the ORI DIY representatives have fulfilled their duties and functions in accordance with the provisions stipulated in Law Number 37 of 2008 concerning ORI, however in terms of the supervision carried out there were several obstacles encountered. The conclusion from this study is ORI DIY Representative has basically carried out supervision of BBPOM Yogyakarta properly and in accordance with applicable regulation,but in the supervision process there are obstacles, namely in the form of (1) differences in the perspective of the main duties and functions of ORI DIY representatives from certain agencies such as the police, (2) the long time spent in the process of issuing final results by BPOM including BBPOM Yogyakarta related to maladministration in the syrup medicine case. However, for these obstacles the ORI DIY still continues to try to overcome them by continuing to carry out significant oversight of the Yogyakarta BBPOM and conducting legal counseling to the Special Region of Yogyakarta Police Departement that they have the same views regarding the duties and functions of the ORI DIY.
