Abstract

Judges' considerations in juvenile court decisions can be of particular concern due to the existence of Perma No. 4 of 2014 which regulates the implementation of diversion for children. This study aims to determine the basis of the judge's consideration in imposing a prison sentence on the Child Offender in addition to the exception of child diversion in Supreme Court Regulation Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System. This research uses normative legal research methods. From the results of the research, it can be concluded that the imprisonment of juvenile offenders is based on juridical and non-juridical considerations of the judge, and in the trial the judge did not find any excuse and justification and based on the results of the Community Research from Bapas so that the juvenile offenders were sentenced to imprisonment. However, in terms of resolving child criminal cases, judges are obliged to seek diversion, one of which aims to prevent children in conflict with the law from deprivation of independence.
