Abstract

Patents are exclusive rights granted by the state to investors for their inventions within a certain period of time, implement the invention themselves or give approval to other parties to implement it. In 2020, the Indonesian government made changes to regulations by issuing the Omnibus Law. The amendment contains the abolition of Article 20 paragraph 2 of the Patent Law, which will have an impact on the loss of obligations of patent holders in Indonesia, especially the obligation to process or use patent processes in Indonesia. This thesis aims to find out the consequences of the abolition of the provisions of Article 20 paragraph (2) of the Patent Law on the obligations of patent holders in Indonesia. The research method used is normative legal research, with secondary data as the main data source. The results of his research show that the abolition of Article 20 paragraph (2) of the Patent Law is because it is considered discriminatory, can reduce foreign investment, and is difficult to implement in practice. The consequences that arise if the regulation is abolished are the loss of the obligations of patent holders in Indonesia to make or carry out the process in Indonesia, and it becomes increasingly difficult to transfer technology and knowledge from inventions.
