Abstract

This thesis discusses the application of fair restorative justice in cases of traffic accidents that result in casualties (Analysis of Decision No. 151/Pid.Sus/2013/PN.Jkt Tim). Empirical research that focuses on actualization or events that occur in everyday life. This thesis was written to know and examine the Implementation of Restorative Justice in the decision issue number: 151/ Pid.Sus/ 2013/PN.Jkt Tim in positive law there is already fulfillment and in this case, where the solution is through the form of restorative boards / youth panels, namely this form of involvement of judges, prosecutors, and lawyers in solving the problem of traffic accidents which result in death. The implementation of the Restorative Justice policy in traffic cases has been aligned with aspects of fairness, legal objectives, meaning and function of criminal law through studies on the characteristics of Restorative Justice, namely the return of problems to parties who have an impact on this issue, namely victims, who commit and citizens. The application of Restorative Justice in this case can be a solution for law enforcement in solving traffic accident cases.
