Abstract
The implications of diversion in the settlement of cases of criminal acts of narcotics abuse committed by children not free problems and constraints, so the diversion attempt does not work as it should. Diversion implication constraints were found in the Magelang district court narcotics diversion decision based on PERMA Number 4 of 2014 the implementation of diversion in the juvenile justice system. Diversion efforts are carried out at the court level there are several constraints to the application of diversion in handling cases of narcotics abuse committed by children in Magelang city, and what are the criminal law policies related to narcotics diversion effort. The study uses normative legal research. The first obstacles is lack of understanding of diversion from the parties, both children and law enforcement officials. Diversion implementation constraints are also related to infrastructure and costs. The second constraints in terms of the execution of the diversion provisions are caused by the supervision carried out in terms of execution because if supervision is not carried out, the diversion provisions will not work as they should. Diversion implication in child narcotics cases in the city of Magelang, criminal law policies related to the regulation of diversion in cases of criminal acts of narcotics abuse by children is said to be good but still not perfect and there are still law enforcement officials who have not carried out their duties in efforts to diversion in accordance with criminal law policies
