Abstract

Local examination is an examination carried out by a judge at the scene of a crime. Generally, local examinations are often found in civil cases, but in practice local examinations can be carried out in criminal cases. Local examinations in criminal cases are carried out at the judge's discretion. Local examination is a form of judge's activeness in seeking material truth which will later be used to increase the judge's confidence in passing a decision. This research discusses the influence of local examinations on judges' decisions in efforts to enforce criminal law in Indonesia. The research method used is normative legal research using primary legal sources and secondary legal sources in the form of statutory regulations, books, legal journals and court decisions. The results of this research are that there is an influence of the local examination on the decision that the judge will hand down on the defendant in the form of the judge's confidence in knowing whether the defendant is guilty or not but it does not affect the sanctions that will be imposed.
