Abstract

Most of the Indonesian society has opened up to embrace the new normal after the Covid-19 pandemic. The loosened social restrictions have the potential to revitalize the economy. People, especially entrepreneurs, are starting to rise and quickly seek opportunities in this new situation. Many entrepreneurs are taking advantage of these opportunities by expanding their businesses. Franchise agreements have become popular as one of the means for entrepreneurs to grow their businesses by opening more branches under different ownership. Every entrepreneur possesses intellectual property in running their business. Intellectual property represents the ideas born from one's hard work and is poured into the business, thus having commercial value. The issue addressed in this writing is that the intellectual property, in the form of trade secrets, held by entrepreneurs is at risk of being misused by others. Trade secrets are crucial in maintaining the continuity of a business because they are at the core of the enterprise itself. The legal urgency of protecting trade secrets is to preserve the innovations generated from human thought and creativity. This writing discusses the efforts that can be made to protect the trade secrets owned by a coffee shop entrepreneur in the city of Balikpapan. The result of this research is the protection that can be implemented for intellectual property trade secrets both preventively through registered licenses and reactively through legal actions.
