Abstract

The background of this research is the environtmental damage caused by illegal gold mining in Gunung Mas regency, Central Borneo. The purpose of this research is to find out the legal aspect of the environtmental damage control due to unlicensed gold mining in Gunung Mas regency. The problem formulation in this research is how to control environtmental damage due to illegal gold mining and what are the obstacles faced while controlling the damage. The legal research that is used in this research is empirical research or field research that focuses in the field data as the primary data source. The result of this research concludes that illegal gold mining activity is hard to stop because this activity has been going on for generations and has become the source of livelihood for the people that live there. The Environtmental Agency also took part to control the environtmental damage that is caused by this mining activity, but their attempt have not run optimally. Meanwhile the perpetrator of gold mines should be more aware of the importance of having legal license in running mining business and also to be aware of the environtmental damage done by the unprocedural mining activity.
