Abstract
The Applicant’s Legal Memorandum on behalf Mr. Noel Samudra present the fact that there is unauthorized mining activity occuring in Dingin Village, Muara Lawa District, Kutai Barat Regency, East Kalimantan, resulting in damage to residential areas, illegal logging, and river pollution in the vicinity of the village, causing turbidity due to sedimentation from the mining activities conducted by Metro Lestami Company. Based on this background, a legal opinion is sought through the Legal Momerandum regarding the right to compensation and environmental restoration for the residents of Dingin Village, Muara Lawa District, Kutai Barat Regency, East Kalimantan, and the method of obtaining compensation and environmental restoration due to illegal mining activities by Metro Lestami Company. The legal opinion that can be provided is that Mr. Noel Samudra and other residents are entitled to compensation, while the right to prosecute environmental damage restoration can only be pursued by a legally recognized environmental organization in accordance with Article 92 of the Environmental Law. The acquisition of compensation can be pursued through two methods, namely non-litigation and litigation, where it is recommended in this Legal Memorandum to resolve the issue through non-litigation means in order to reach a win-win solution for all parties involved.
