Abstract

A defined territory is one of the important qualifications of a country according to International Law. Nagorno-Karabakh border case between Armenia and Azerbaijan is one of the border disputes that has not yet been solved until now. This research aimed to investigate claims between two countries about Nagorno-Karabakh and the best means of international dispute settlement that should be done according to International Law. This research uses deductive method, the data obtained with doing research from literature review and online interview. The result of the research revealed that the claims of Azerbaijan are protected by Treaty of Batum, autonomous oblast by SSR Azerbaijan and uti possidetis juris. On the other hand, Armenia claims that Nagorno-Karabakh has all the requirements to be a country as a republic. The step of dispute settlement could be done through ongoing judicial proceedings by the International Courts of Justice (ICJ) regarding alleged violations of the International Convention on the Elimination of All Forms of Racial Discrimination (CERD) or hand over the case to United Nations. The dispute settlement means written above are some of the way out solutions for the safety and peace condition among both of the country.
