Abstract

Article 22 of the 1945 Constitution gives authority to the President, namely that in cases of urgent need, the President has the right to enact government regulations in lieu of law. However, the government regulation in lieu of law must be approved by the House of Representatives in the following session, if it does not receive approval it must be revoked. The birth of Law no. 6 of 2023 after receiving approval from the House of Representatives, originating from the existence of Government Regulation in Lieu of Law no. 2 of 2022, which in its preamble section is an order to implement the Constitutional Court Decision Number 91/PUU-XVIII/2020. In this decision the Constitutional Court ordered improvements to Law no. 11 of 2020 within a period of two years, but the President instead issued a Government Regulation in Lieu of Law which is not in accordance with the orders of the Constitutional Court Decision. even though the conditions for issuing a Replacement Government Regulation must also meet the requirements of compelling urgency. Normatively, Juridically, the formation law No. 6 of 2023 is not contradictory in its formation. However Historically, Theoretically and Sociologically Normatively contradictory in its formation.
