Abstract
in decision number 1102/K/Pid.Sus the issue where the judex juris judge decided based on special minimum provisions. This research uses normative methods. The results of the research show that the judex juris judge in imposing a criminal sentence below the minimum has considered the objectives of the Narcotics Law Number 35 of 2009 concerning Narcotics, based on SEMA as a middle way in believing the defendant is guilty of violating article 127 even though this article is not written in the indictment
