Abstract

Advocate is a respectful professional (officium nobile), in which in conducting the professional they are free, self-managed and responsible. They perform honest, fair trial that having legal certainty for all justice seeker. In conducting the professional, an advocate has norm that should be obeyed, namely Ethic Code of Advocate. The code is the highest law to do profession that ensures and protect, as well as bring to each advocate to be fair and responsible in conducting their profession either to client, trial, partner, country or to people, and especially to themselves. However, implementation of the Code is not suitable to the fact because it frequently occurs deviances. In relation to advocate in trial mafia, it indicated that Ethic Code of Advocate did not function as ruled and also indicated lower morality of the advocate. It go far away from mention of the respectful, noble profession (officium nobile). Based on the fact, then writer studied the research concerning role and function of the Ethic Code to prevent Advocate’s malpractice. This research was normative, focused on positive law such as the regulation and Ethic Code of Advocate. Based on the study, it was expected that Ethic Code could be enact in real and could destruct practices of advocate mafia in trial.
