Abstract

This research was about folklore rights legal protection of Indonesian traditional dances aimed to know and to examine the governmental roles in protecting folklores of traditional dances from other countries who intended to commit unlawfully. This was a normative legal research. The normative legal research was also a doctrinal legal research. In this type of legal research, laws was sometimes conceptualized as what had been written in the regulations (law in book) or laws was conceptualized as norms that were human principles to behave that was regarded as deserved. This research used legal comparison and legal political approach. Legal materials used was a primary legal materials among others: Constitution of The Republic of Indonesia 1945, Regulations, international conventions; a secondary legal materials were among others: textbooks on laws, scientific writing, legal journals, foreign journals, scholar opinions, legal cases related to discussions on folklore rights protection on Indonesian traditional dances. This research and discussion showed that folklore protection issues still caused problems like as no Governmental Regulations (PP) that could be enforcement regulation to protect folklores in details and did not appoint an authorized board as a state representative in folklore protection from lawinfringed use by foreign parties.
