Abstract

Where as United Nations has the role to maintain the international transquility and security appropriate with the United Nations Charter. The security council is an United Nations council which has primary function and the key increating the world transquility and security, in United States of America invasion case to Iraq in 2003 it shows in effectivity of United Nations security council’s role in maintaining the international transquility an security. This matter has been executed solely by the regular member of United Nations, namely United States of America it self and its alley which having invasion to Iraq without any reasonable legal base, it is only a pre – emptive strike doctrine as an excuse. This is an international legal breaching and must be punished/ sanction for such international legal breaching. The problem is, there is no legal base which can be objected to United States of America due to such invasion is capable to blur the international law to be the international morality. The solution for such problem is the general assembly gave recomendation to United States of America to stop the aggression to Iraq, The United States of America invasion action is executed in the name of United State of America based on the concept of inter – relation among the United Nations councils and United States of America has responsibility for the reconstruction and rehabilitation in Iraq as the effort of the country responsibility.
