Abstract
Controlling and observation of justice decision is new subject in procedure criminal law in Indonesia. This institute formerly is adaptation or adopted from France since 1959 famous by name of le juge de l’aplicationdes peines that is a judge that given contolling duty to penalization (social). Initially arrangement about contolling and observation implementation of justice decision arranged in fundamental rule of judicial power section 33(2), Law number 14 Year 1974 then readjusted in KUHAP Capter XX section 277-283 about contolling and each justice there must judge given specialized task to assist chief in doing expropriatition. Based on the subjeck very importance existence role of judge in subjeck of controlling and observation implementation of justice decision to give bebefit that expected for convict, therevore, judge claimed must stand active in and outside wall of penitentiary by doing controlling and observation duty so purpose of crime can be reached.
