Abstract

Writing laws is entitled on the role of the prosecutor's commission to supervise the prosecutor's duty as a prosecutor. Background factors that are writing this law depart from the public distrust of prosecutors on the general performance of institutions in Indonesia. The method used in this study adalah normative, in the writing of this law the background problem research is how commissions work in a prosecutor's, prosecutor and what constraints it Prosecutorial Commission in conducting supervision. In the research found that to be able to supervise, commission prosecutors can not directly supervise, this is because there is an internal oversight in the body such that first the prosecutor handling his case. Constraints from the commission in supervising prosecutors could be internal constraints and external constraints, internal constraints such as do not want a deterioration of the invisibility of these prosecutors who are in trouble, while the external constraints such as the existence of barriers at certain levels who want to hamper the work of the commission attorney. Therefore, the commission shall fungis of this prosecution in order to enforce the same as a function of the other commissions in Indonesia is a prominent and visible role, so let the community participate in helping run the prosecutor's duty of this commission
