Abstract
Corrupt behaviour can be committed by any civilian or military institution, therefore the Government of Indonesia has made legal instruments to eradicate and prevent corrupt behaviour and even a special institution to eradicate corruption has been prepared, namely the Corruption Eradication Commission (KPK). Military institutions are institutions that are considered as institutions that have a high attitude of discipline, so it is not surprising that they have their own law enforcement officers to prevent any actions that can make the name of the military institution bad. The phenomenon of military personnel occupying positions in civilian institutions in this research is the National Search and Rescue Agency (Basarnas) of the country has led to confusion of authority between law enforcement officials who are authorised to enforce the law on a criminal offence, especially on the crime of corruption. Therefore, in this research, there is a problem raised in a real case, namely, whether the KPK has the authority to investigate, investigate and prosecute corruption offences committed by TNI members who hold positions in non-military institutions (Basarnas) in Indonesia. This research will be conducted using normative research methods by looking for information sourced from positive law in Indonesia which is then analysed so that it can be concluded that the KPK has the authority and can pour the results of these conclusions into suggestions that can be used as a solution in solving problems regarding the collision of authority that occurs between law enforcement which is authorized to investigate, investigate and prosecute members of the military who hold positions in non-military institutions in Indonesia.
