Abstract

This legal research discusses the independence of the Financial Services Authority (OJK) in Law number 4 of 2023 from a juridical aspect. The problem raised in this research is that changes in the PPSK Law remove the phrase free from interference from other parties. This change will provide potential for interference from other parties. The research method used in this research uses normative juridical research, by comparing Law Number 21 of 2011 with the 1945 Constitution and looking at secondary legal sources in the form of journals and other legal research related to OJK independence. Then look at Law number 4 of 2023 concerning OJK independence. The results of this research show that there are criteria for OJK independence that prevent OJK from becoming an independent institution, namely financial independence.
