Abstract
Advances in technology and information are driving the banking sector in a new era, namely digital era banking or the development of electronic banking. The emergence of the digital banking era has various consequences. Adverse actions that abuse this digital banking service often occur and are often found. Therefore, the purpose of this legal writing is to analyse the responsibility of banks in mobile banking services for losses suffered by customers. By using juridical normative methodology, with secondary data sources used as the main data consisting of primary legal materials and secondary legal materials obtained through interviews with Bank BPD DIY. Data collection techniques to answer the problem formulation through literature study and interviews. Based on the results of the study, the bank’s responsibility for losses suffered by mobile banking user customers, namely the bank in running digital mobile banking services is in accordance with the obligations stipulated in POJK Number 21 of 2023 concerning Digital Services by Commercial Banks. The bank is not responsible for the losses suffered by customers who use mobile banking because the losses suffered by customers are the fault/negligence of the customers Themselves. Also regulated in Article 10 paragraph (2) POJK Number 22 of 2023 concerning Consumer and Community Protection in the Financial Services Sector, which contains PUJK can prove the existence of errors/legislation in the financial services sector, the PUJK is not responsible for customer losses. The suggestion is that banking institution can create indicators that better secure the security of automated messages sent to customers. Inform customers about good security practices, such as avoiding giving OTP codes to anyone.
