Abstract
Land has a very important role in people's lives. Its function includes residence, social, religious and worship aspects, as well as acting as a location for earning income to meet daily needs. The very basic importance and position of land has resulted in the formation of basic regulations governing agrarian affairs, one of which is land, namely in the UUPA. One of the subjects touched upon in the UUPA is mortgage rights. Along with technological developments, the Ministry of ATR/Ka BPN has created an electronic-based service known as Electronic Mortgage Rights (HT-el). Currently, services related to mortgage rights, including those related to registration of mortgage rights, can be provided electronically. The implementation of electronic registration of mortgage rights has begun to be implemented in Land Office areas in Indonesia, one of which is the West Sumba Regency Land Office. However, in reality, because electronic registration of mortgage rights is something new, it is not uncommon for there to be various problems and obstacles which ultimately raise the question of whether the implementation of electronic mortgage registration complies with existing regulations or not. Therefore, the author is interested in carrying out thesis research regarding the implementation of electronic mortgage registration at the West Sumba Regency Land Office. This research is a type of empirical legal research using primary data and secondary data. Based on the research, it can be seen that the process of registering Mortgage Rights (HT) through the electronicMortgage Rights system (HTel) in West Sumba Regency has been implemented based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 5 of 2020 concerning Integrated Mortgage Services Electronically, especially in Articles 9 to 16.
