Abstract

Marriage law is a key aspect in regulating family relationships in Indonesia. Law Number 1 of 1974 concerning Marriage serves as the legal basis governing the principles of marriage, including the positions of husbands and wives. Although based on the principles of Pancasila and cultural values, the law still reflects a patriarchal family model. This patriarchal mindset can have significant impacts, one of which is the phenomenon of "fatherless" or the absence of fathers within families. This research aims to analyze the positions of husbands and wives in the Marriage Law and its relation to the emergence of the "Fatherless Country" issue in Indonesia. The research method employed is normative legal research, utilizing document analysis and literature review to explore the regulations governing marriage and their impacts on family dynamics. The results of the analysis indicate that Law Number 1 of 1974 tends to reinforce patriarchal mindsets in society, which in turn can contribute to the occurrence of "fatherless" situations.
