Abstract

The financial services sector is one of the pillars of in life and has led to very rapid development. Law No. 4 of 2023 on Financial Sector Development and Strengthening (UU PPSK) is a legal framework designed to regulate and strengthen the financial sector. Article 8B of the PPSK Law makes the Financial Services Authority the only institution that can apply for a bankruptcy declaration against Financial Services Business Actors, especially securities companies. The purpose of this research is to determine the government's considerations for adding the authority of the Financial Services Authority in submitting a bankruptcy application as well as the implementation of the mechanism for adding the authority of the Financial Services Authority. This research uses a descriptive normative juridical research method, namely identifying the main problems that will be discussed thoroughly using existing regulations. The research results show that the OJK, within its authority, filed a bankruptcy statement based on the urgency to improve the financial sector which can support strong, stable and reliable economic growth, this is also to ensure legal certainty and justice for financial service businesses and also to increase trust public towards financial service business actors, especially in securities companies. OJK needs to issue implementing regulations which up to now OJK has not issued implementing regulations as part of its increased authority.
