Abstract

The title of this research is Legal Protection Against Leasing Debtors From Forced Withdrawal by Debt Collectors After the Release of the Constitutional Court Decision Number 18/PUU-XVII/2019. The purpose of this research is to answer public unrest because of the rampant cases of forced withdrawal of objects that are fiduciary guarantees and at the same time provide solutions related to legal efforts to debtors in the event of forced withdrawal of objects that are fiduciary guarantees carried out by debt collectors as well as testing the essence of the executorial power possessed by creditors after the issuance of the Constitutional Court decision, which is where there is a change in meaning related to the execution mechanism that should no longer be carried out by authority. This study uses normative research and primary data as teh main data and secondary data as supporting data. The results of the interview were obtained by conducting a direct interview with an advocate in Jakarta. The results of this research are about legal remedies either civil or criminal that can be done by debtors if they feel aggrieved from forced withdrawal and review related to changes in the essence of the executorial power owned by the creditor related to the execution mechanism, where the execution can no longer be carried out by authority after the issuance of the Constitutional Court Decision Number 18/PUU-XVII/2019.
