Abstract

This study aims to describe and analyze the procedure for resolving traffic accidents involving minors in the Klaten Regency Resort Police (Polres). Identify the factors that affect the settlement of traffic accidents involving minors at the Klaten Police Station. The method used in this study is empirical law research. The method of empirical legal research is a research that focuses on social facts or an analysis of the results of literature discoveries has been briefly explained in the research in the field to connect several social findings. The primary data in this study was obtained directly from the information of the respondents through interviews. Secondary legal materials are books, legal journals, mass media (internet), legal scientific writings related to the object of this research. The result of this research is that the procedure for resolving traffic accidents involving minors begins with reporting by the victim, witness, or other parties. The police then went to the location to conduct a preliminary examination and process the crime scene, collect evidence and witness statements. The child involved was taken to a health facility for a medical examination. The police examine the perpetrator and the victim, and if the perpetrator is a child, assistance by parents or BAPAS is required. Based on the examination and evidence, the police made an accident report. Mediation between the perpetrator and the victim was facilitated by the police to reach a peace agreement. If no agreement is reached, the case will proceed to further legal proceedings, including investigation and submission to the prosecutor's office. The settlement of traffic accidents involving minors is influenced by various factors such as age, psychological condition, and the status of the perpetrator as a student. The victim's condition and the severity of the injury determine the complexity of the legal and medical process. The willingness to make peace, the availability of evidence and witnesses, local policies, and support from relevant institutions such as BAPAS and health institutions also play an important role. The quality of police services and community involvement in providing information and moral support are very influential. All of these factors determine the efficiency and effectiveness of case resolution
