Abstract

Double certificate, that is, a plot of land has more than one certificate, completely or partially overlapping. . Double certificates occur because the certificate is not mapped on the land registration map or situation map of the area. The aim of this research is to determine the resolution of the existence of double land certificates at the Surakarta City Land Agency Office. This research is empirical legal research, supported by using probability sampling techniques. By using primary data sources obtained directly from respondents regarding the objects studied. The results of the research and discussion show that: Settlement and Legal Consequences of the Existence of Double Certificates at the Surakarta City Land Office, namely the Head of the Surakarta City Land Office received the complaint file and the reporter had a duplicate certificate between HM No. 1898 and HM No. 3967, both located in Bonorejo Village RT 12 RW 015 Nusukan, Surakarta City. Then, the Director of the Land Office asked for mediation to be held between the parties to the dispute. The Head of the Dispute Control and Handling Department mediates to a greater or lesser extent. The Mediation Meeting was held in the Surakarta City Land Office Meeting Room, and both parties were invited. Second, a peace declaration is made and signed by both parties; This minutes of dispute resolution has the same legal weight as a formal agreement between the parties. Therefore, the Surakarta City Land Office has taken the following steps to eliminate the possibility of duplicate certificates in the future: (1) implementing the Land Registration Map Procurement program; (2) publishing the land registration process; and (3) publish village land administration. From the results of this study, the author suggests that in land registration, before it is processed or measured, a check must be carried out on the land registration map to find out whether the plot of land has been registered (certified) or not at the Land Office.
