Abstract

Children are the future generations of the nation who must receive protection and well-being. The state, society, parents, and families are obliged and responsible for providing protection to children. The abuse of narcotics is regulated in Law Number 35 of 2009 concerning Narcotics, which stipulates criminal sanctions to deter abusers and traffickers of narcotics and precursor narcotics. Data from the National Narcotics Agency on drug abuse among students nationwide records more than 3.7 million users, with 1.1 million of them being students and university students. Based on research on the normative legal research method used in this study, criminal responsibility of child offenders in drug-related crimes in Yogyakarta city, it has been handled properly by relevant parties and is in accordance with legal regulations. Especially under Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which prioritizes the protection of children as mandated by Law Number 35 of 2014, which amends Law Number 23 of 2002 concerning Child Protection. In the handling process, from the investigation to the prosecution and examination of cases involving underage offenders of drug-related crimes in Yogyakarta city, diversion is always attempted first by the police, the prosecution, and in the court.
