Abstract

Indonesia is a state of law, which believes that the concept of a state of law can improve the welfare of its people. National development is one of the steps taken to improve the welfare of the Indonesian people. One of the programs that contribute greatly to national development, especially the country's economic development, is the procurement of goods/services by the government. Regulated in Presidential Regulation Number 16 of 2018 that the process of procuring government goods and services funded by APBN / APBD, begins with the process of determining the goods and services needed for the objectives of government organizations and ends at the stage of delivery of procurement results. Where policies in this process are formulated by the Government Goods and Services Procurement Policy Agency (LKPP). Based on this Presidential Regulation, the Electronic Procurement Service (LPSE) is also established with technical operational provisions stipulated in LKPP Regulation Number 14 of 2018. In Article 1 Point 45 of West Kutai Regent Regulation Number 16 of 2017, it is defined that the LPSE of West Kutai Regency is established by a regent decree as an organizational unit in the Goods and Services Procurement Section. Since 2012 the government has used e-procurement for tenders and selection, but not yet fully for all procurement activities. Tender announcement, registration, explanation of tender documents (aanwijzing), bid submission and opening, qualification assessment, and winner determination are all steps in this process. This research aims to find out how the process of implementing electronic procurement of goods/services (e-procurement) in the West Kutai Regency Government, as well as to find out what are the obstacles and how to overcome these obstacles. The method used in this research is normative legal research in which the object of legal research is the implementation of legal rules in the implementation of electronic procurement of goods/services (e-procurement) in the West Kutai Regency Government. The results of the research conducted by the author state that the implementation of electronic procurement of goods/services (e-procurement) in the West Kutai Regency Government is in accordance with applicable regulations but there are still obstacles in the implementation process. Some strategies that can be used to overcome these obstacles include improving the quality of training and development of personnel, utilizing technology, increasing the visibility and utilization of LPSE, training and development of Local Providers in West Kutai Regency.
