Abstract
This Legal Memorandum discusses legal issues regarding the Criminal Responsibility of Streamers Who Earn Money from Online Gambling Sites. The development of technology makes the modus operandi of crime also develop. This happens to streamers who do live streams and get money from online gambling sites through third services where the giving of money also includes messages in the form of promotion of the online gambling site. Streamers who get money from online gambling sites also participate in promoting online gambling sites by displaying and reading the message. The problem that occurs is how criminal responsibility for the streamer's actions. This Legal Memorandum uses normative legal research methods, which is research conducted by focusing on the applicable laws and regulations as primary materials and legal theories or doctrines as secondary materials. The material collection technique used is a literature study. In the analysis that has been carried out, the answer is that the streamer's actions are criminal acts that can fulfill the elements in Article 55 paragraph (1) 1st and Article 303 paragraph (1) 2nd of the Criminal Code, Article 27 paragraph (2) jo Article 45 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. The streamer also has qualifications for criminal responsibility because there is guilt in committing the criminal act so that it can be subject to punishment.
