Abstract

General elections are considered as the earliest stages of the various links of a democratic state life, so that general elections are the core of the mechanism of a democratic political system. The process of organizing democratic elections, of course, it must also provide a legal mechanism to resolve possibility election violations. The purpose of this research is to find out the regulations regarding the settlement of disputes over the general election process in the Administrative Court. Article 470 to Article 472 of Law Number 7/2017 on General Elections has regulated the authority of the Administrative Court to resolve disputes over the electoral process. In order to carry out the authority to resolve disputes over the electoral process, Supreme Court Regulation No. 5/2017 on Dispute Resolution in the General Election Process at the Administrative Court has been issued. The research method that is applied in this legal writing is a normative research method, while the data are obtained through library research and interviews with the experts. Based on the results, it can be concluded that the Administrative Court is authorized to resolve general election administration disputes. Administrative Court has obstacles such as the lack of socialization related to the object of the dispute and dispute resolution procedures, the changing regulations of the general election commission, and the short grace period for filing a lawsuit. The solution is for the Administrative Court to coordinate with the election organizers regarding the object of the dispute and dispute resolution procedures, coordinate with the general election commission regarding the new regulations, and provide additional time when filing a lawsuit.
