Abstract

The development of information and communication technology, especially on social media, has provided convenience in various aspects of life. On the other hand, this progress also opens up opportunities for online-based sexual harassment. One form is the dissemination of sexually charged content without the victim's consent, which can have a negative impact on the victim's mental and social health. This research aims to analyze the fulfillment of the victim's right to remove sexually charged content that was disseminated without her consent. Using a normative juridical approach, this research examines Indonesian regulations related to the fulfillment of the right to content removal for victims of online-based sexual harassment. The results of this study show that the party obliged to remove sexually charged content in online media is carried out by the public prosecutor accompanied by the making of minutes after an inconclusive court decision and the Social Media Platform service provider.
