Abstract

Marriage within the same clan is a marriage that is prohibited in Toba Batak society, therefore the role of the Dalihan Natolu Traditional Institution is important in preventing marriages from within the same clan. The purpose of this study was to determine the the role of the Dalihan Natolu Traditional Institution in preventing marriages within the same clan according to Toba Batak Customary Law in North Tapanuli Regency. The method used in this research is normative research, focusing on the facts of legal norms and social norms. The result of this research is holding a clan social gathering which is held once a month led by each clan leader, reminding the public of the prohibition on intermarriage within one clan through clan marches and carrying out outreach regarding clan genealogy. The role of the Dalihan Natolu Traditional Institution in preventing marriages within the same clan in North Tapanuli Regency has been carried out well, but this has not been optimal because there have been no activities regarding the importance of kinship for the younger generation in North Tapanuli Regency.
