Abstract
Criminal disparities are a problem that has long been the focus of legal scholars and practitioners. The meaning of criminal disparity itself is the imposition of different sentences related to similar criminal acts or related offenses whose dangerous nature can be compared without a clear evidentiary essence. The method in this research uses a type of empirical legal research where law is seen as a structured pattern of behavior and social interaction. A form of disparity in the imposition of fines in court decisions regarding cases of criminal traffic violations at the Wates District Court is the imposition of different fines in cases of violations of article 281 and article 285 of Law Number 22 of 2009 concerning Road Traffic and Transportation. The reason for the disparity in court decisions is because the judges have their own independence and cannot be intervened by others.
