Abstract

Criminal liability is inherently associated with criminal acts. Each criminal act has its own liability. Criminal responsibility is determined based on fault, the capacity to be held accountable, and the consequences involved. The case of the death of a search and rescue (Basarnas) member during the evacuation of a suicide attempt in Jayapura is a result of negligence that led to the loss of another's life, caused by the suicide attempt by an individual with a history of mental disability. Therefore, this legal writing will focus on discussing how criminal liability applies to individuals with mental disorders whose negligence results in the loss of another's life. The research method used in this writing is normative legal research. The criminal liability of individuals with mental disorders in the case of the Basarnas member's death is assessed based on the provisions of the Penal Code and Law Number 1 of 2023 concerning the Penal Code. The analysis concludes that the suicide attempt perpetrator is capable of being held responsible for their negligent actions, and the perpetrator is subject to criminal liability as a consequence of their conduct.
