Abstract

This research examines the implementation of the proportionality principle in the diversion process for child abuse cases involving both child perpetrators and victims at the investigation level in Polresta Sleman. Utilizing a normative legal research method with a juridical-normative approach, the study analyzes secondary and primary legal materials, including legislation and literature, complemented by interviews with investigators. The research reveals that while the diversion process aligns with Law Number 11 of 2012 on Juvenile Criminal Justice System, significant challenges persist in its practical implementation. Factors impeding successful diversion include conflicts between perpetrators and victims, compensation disputes, and investigators' limited capacities. The findings demonstrate that despite comprehensive legal frameworks protecting children's rights, the actual implementation of diversion remains suboptimal. Key obstacles include differing interests between parties, inadequate negotiation mechanisms, and insufficient understanding of proportionality principles. The study concludes that systematic efforts are necessary to enhance investigators' skills, develop more holistic conflict resolution approaches, and ensure the best interests of children are consistently prioritized within the juvenile justice system, ultimately recommending more nuanced and child-centered strategies for addressing juvenile offenses.
