Abstract

echnological developments have led to changes in financial services, giving rise to the term financial technology or fintech. Fintech is one of the fastest growing financial services industries, especially the information technology-based money lending and borrowing services (LPBBTI) industry. This study aims to determine the legal relationship between the parties in LPBBTI and how the legal consequences for funders if the funds are not returned by the organizer are analyzed with the case that occurred at PT Tani Dana Madani Indonesia. The method used in this research is normative research by conducting a literature study. The results showed that the legal relationship between the parties was born from the parties' agreement. It consists of two agreements, namely the user agreement and the funding agreement. Legal consequences arising from the legal relationship between the funder and the organizer result in all risks not being the responsibility of tanifund, but the responsibility of the funder.
