Abstract

This research analyzes law enforcement against juvenile offenders of maltreatment that resulted in death in Bantul Regency. The research method used is normative juridical with the main focus on the application of the legal process and obstacles in the implementation of diversion based on the Law on Juvenile Justice System (SPPA).The results showed that the Bantul District Court Decision Number: 27/Pid.Sus-Anak/2022/PN.Btl was in accordance with the provisions of the SPPA Law, especially in the application of restorative justice and rehabilitative measures for child offenders. Although diversion could not be carried out due to serious criminal offenses, the judge still considered the best interests of the child by imposing measures in the form of social rehabilitation. The rights of children in the judicial process have also been fulfilled, including legal assistance, protection during trial, and sanctions that emphasize guidance rather than punishment.This decision reflects a balance between justice for the child perpetrator and the victim. Although the restorative approach may be considered inadequate for the victim's family who want a harsher punishment, the juvenile criminal justice system focuses more on rehabilitation and recovery than punishment.
