Abstract
The issue analyzed in this study pertains to discrepancies experienced by workers regarding employment status, contract duration, termination of employment (PHK), and compensation, as reflected in Decision Number 80/Pdt.Sus-PHI/2023/PN.MDN. This research employs a normative method, utilizing a statutory approach and case study analysis to examine issues related to employment status and workers' rights. The findings of this study indicate that the judicial considerations in Decision Number 80/Pdt.Sus-PHI/2023/PN.MDN do not align with the prevailing labor laws, namely the Manpower Law, the Job Creation Law, and Government Regulation Number 35 of 2021. The inconsistencies include the employment status of Dian Ratna, who should have been classified as a permanent employee (PKWTT) rather than a fixed-term contract worker (PKWT). This misclassification affects the legal application of employment termination (PHK), particularly concerning the grounds for termination and the amount of severance compensation determined in the ruling
