Abstract

State of Indonesia consists of many islands, it causes a variety of culture, race, ethnicity, religion, and tradition. Diversity is also no doubt trigger a conflict because the difference of living in society. Conflict in Sampang Madura is one form of national disintegration that threaten the stability of the State. In the completion of social conflict can not only use the litigation, but the litigation should be applied to non-recoverable state. Criminal law is applied in dealing with conflict in Sampang Madura little attention to the victims of the conflict. State Criminal law is only exposes offenders to the State instead of the victims of crime, so that the position of the victim is considered less important. The government should give more attention to the victims of social conflict because it is the responsibility of the State government as a political tool. Many conflicts in Indonesia that did not get attention from the government, the government as the highest organization in a state that should provide protection to its citizens is itself involved a foul. Whereas if only based on the National Criminal Justice issues of social conflict will not be completed because the criminal law only provides a deterrent for the criminals instead of providing rehabilitation and recovery in order to create better circumstances. In Criminal Law victims of crime only serves as a witness the person who menbantu the proceedings in the decision by the judges but the victim does not get compensated for the losses suffered.
